1. Eligibility

You must be at least 18 years old to use the Service, and old enough to lawfully view sports-betting-related information where you live (generally 21 in the United States). You are responsible for ensuring that your use of the Service is legal in your jurisdiction.

2. Entertainment and informational use only

The Service provides sports data, analysis, model outputs, and predictions for entertainment and informational purposes only. It is not a sportsbook, does not accept wagers, and does not provide financial, investment, legal, or professional betting advice. See our Disclaimer, which is incorporated into these Terms by reference. You are solely responsible for any decision you make based on the Service.

3. License and acceptable use

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal, non-commercial use. You agree that you will not, and will not permit anyone else to:

• Use any robot, spider, scraper, crawler, headless browser, or other automated means to access, monitor, copy, harvest, or index any part of the Service or its data;
• Circumvent, disable, or interfere with any rate-limiting, access control, or security feature of the Service;
• Copy, reproduce, republish, resell, sublicense, or redistribute any content, data, ratings, picks, or records from the Service, in whole or in part, for any commercial purpose or in any public-facing product;
• Frame, mirror, or present the Service or its content as your own;
• Place an unreasonable load on our infrastructure, or attempt to gain unauthorized access to any system, account, or data;
• Use the Service for any unlawful purpose or in violation of these Terms.

We may monitor for, block, and take action against automated or abusive access, including blocking IP addresses and pursuing available legal remedies.

4. Intellectual property

The Service and its original content, features, design, model outputs, ratings, and compiled records are owned by BallKnowMe and are protected by intellectual property laws. Third-party names and marks (teams, leagues, data providers) belong to their respective owners and are used for identification and commentary only. Nothing in these Terms transfers ownership of any content to you.

5. Subscriptions and payments

The following applies only if and when paid subscriptions are offered.

• Billing. Payment is processed by a third-party payment processor; we do not store your full payment card details. You authorize recurring charges at the price and interval disclosed at checkout.
• Auto-renewal. Subscriptions renew automatically at the end of each billing period until cancelled. We disclose renewal terms clearly before you subscribe, as required by applicable law.
• Cancellation. You may cancel at any time; cancellation stops future renewals and takes effect at the end of the current billing period.

• Price changes. We may change subscription prices with advance notice; changes apply to subsequent billing periods.

Paid content does not change the nature of the Service. Subscriptions provide access to research, data, and analysis for entertainment and informational purposes. We do not guarantee any outcome, profit, or result, and subscribing does not entitle you to a refund based on the performance of any pick or prediction.

6. No warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY INFORMATION OR PREDICTION WILL BE ACCURATE OR PROFITABLE.

7. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BALLKNOWME AND ITS OWNERS AND OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, WAGERS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE — INCLUDING ANY LOSS RESULTING FROM RELIANCE ON ANY PREDICTION OR INFORMATION. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) US $100.

8. Indemnification

You agree to indemnify and hold harmless BallKnowMe and its owners and operators from any claims, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

9. Third-party links and data

The Service may reference or link to third-party sites, data, or services (including sportsbooks). We do not control and are not responsible for third-party content, terms, or practices. Any interaction you have with a third party is solely between you and that third party.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms.

11. Changes to these Terms

We may update these Terms from time to time. Changes are effective when posted, with the “Last updated” date revised. Your continued use of the Service after changes are posted constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. You agree that any dispute will be brought exclusively in the state or federal courts located in Pennsylvania.
